Buying Property in Paraguay as a Foreigner
Legal, Property and Investment Guide
Paraguay is increasingly considered by international buyers looking for residential property, investment opportunities and long-term exposure to a growing South American market. Foreign nationals can generally acquire urban real estate under the same basic ownership framework as Paraguayan citizens.
For someone buying from abroad, however, a successful acquisition has two distinct dimensions: finding an appropriate real-estate opportunity and independently verifying the legal security of the transaction.
The most common risk is not being denied the purchase — it is completing it without the right commercial and legal checks.
1. What Makes the Process in Paraguay Different
General legal framework
- Foreigners can generally own urban real estate in Paraguay.
- The transfer is formalized through a public deed before a Paraguayan notary (escribano).
- Ownership, liens, mortgages, litigation and other relevant title issues should be verified before signing or making material payments.
- Rural property in sensitive border areas can be subject to specific restrictions depending on location, nationality and ownership structure; these cases require individual legal review.
2. The General Steps of a Purchase
Define location, property type, investment objective, budget and whether the acquisition is for personal use, rental income or long-term investment.
Review the registered owner, title, encumbrances and relevant documentation before assuming contractual obligations.
Formalize the transfer through the appropriate notarial deed and complete registration in Paraguay.
Finding the Right Property in Paraguay
Legal due diligence protects a transaction, but it begins only after a buyer has identified an opportunity worth pursuing.

3. What a Foreign Buyer Needs
Typical documentation
- A valid passport or accepted identification.
- Documentation supporting the origin and availability of funds when required by financial or compliance procedures.
- A properly drafted power of attorney when the buyer will be represented in Paraguay.
- Additional corporate, tax or beneficial-ownership documentation when the purchaser is a company or another legal entity.
The exact documentation depends on how the acquisition is structured. Individual ownership, corporate ownership, financing and rental or investment activity can create different tax, banking and compliance requirements.
4. Can the Purchase Be Completed Without Traveling to Paraguay?
In many transactions, representation through a special power of attorney can allow important steps to be completed without the buyer being physically present in Paraguay.
The document normally needs to satisfy both the formal requirements of the country where it is executed and the requirements for recognition and use in Paraguay.
International powers commonly involve
- Apostille or consular legalization, depending on the country of origin.
- Official translation when the document is not in Spanish.
- Notarial formalities and, where applicable, registration in Paraguay.
- Precise authority covering the specific acts the representative must perform.
Remote purchasing is possible in many cases, but the power of attorney, banking process and transaction structure should be planned before the closing stage.
International transfers can also trigger source-of-funds and compliance reviews. Buyers should anticipate these requirements early rather than treating the transfer of funds as an administrative detail at the end of the process.
5. Independent Legal Review Before Purchase
Once a property has been identified, the legal review should be independent from the commercial decision to acquire it.
Paixão & Asociados assists national and international clients with legal due diligence, documentation, contracts, powers of attorney and representation related to property transactions in Paraguay.
This separation is intentional: the real-estate opportunity can be identified commercially, while the legal team evaluates the transaction from the standpoint of title, documentation and legal risk.
