Inheriting Property in Paraguay
A Guide for Foreign Heirs

How Paraguayan succession law works when the heir lives abroad — what documents are required, how legal representation works from a distance, and how to protect an inherited estate without needing to travel.
International Succession Foreign Heirs Paraguay Legal Representation

Discovering that you have inherited property, land, or other assets in Paraguay — often unexpectedly, and often while living thousands of kilometers away — raises a question most foreign heirs are not prepared for: what happens now?

Paraguayan succession law follows its own rules, timelines, and documentation requirements, and very few of them resemble the inheritance process in the United States, Europe, or elsewhere in Latin America.

For a foreign heir, the distance is not just geographic. It is legal, linguistic, and procedural.

1. Why Inheriting in Paraguay Is Different for Foreign Heirs

When the person who passed away held property, bank accounts, or business interests in Paraguay, that estate generally needs to go through a local succession process (sucesión), even if the heir lives abroad and even if a will or succession process is already underway in another country.

The Legal and Practical Point

  • Paraguayan courts and civil registry offices are involved, not just the heir's country of residence.
  • Documents issued abroad typically need to be apostilled and, in many cases, officially translated.
  • The estate may need a court-appointed or family-designated administrator while the process is ongoing.
  • Real estate cannot usually be sold or transferred until the succession is formally resolved before a Paraguayan court.

None of this is unusual by international standards — but it is unfamiliar, and unfamiliarity is where foreign heirs lose the most time.

2. The Most Common Situations We See

1

A relative who emigrated decades ago

Many Paraguayan families have members spread across Argentina, Brazil, Spain, and the United States. Heirs abroad often don't know the property exists until much later.

2

A foreign buyer who passed away

Retirees and investors increasingly choose Paraguay. Their heirs, who may have never visited, must navigate a legal system they have no prior connection to.

3

Estates across multiple jurisdictions

When assets are split across countries, the two processes need careful sequencing so that one does not delay or contradict the other.

3. What a Foreign Heir Typically Needs

Documentation Checklist

  • A certified and apostilled death certificate
  • Proof of kinship or heirship (or a foreign court's declaration of heirs)
  • Any existing will, apostilled and translated
  • Identification documents for all heirs involved
  • A power of attorney authorizing a legal representative in Paraguay to act on the heir's behalf

The power of attorney is often the single most important document — it allows the process to move forward without the heir needing to travel.

4. Can This Be Handled Without Traveling to Paraguay?

In most cases, yes. Through a properly drafted and apostilled power of attorney, a local legal representative can act on the heir's behalf throughout the succession process — filing documents, appearing before the relevant court, coordinating with the civil registry — without the heir being physically present in Paraguay.

This is the model Paixão International Desk is built around: one point of contact, coordinated legal representation, and clear communication throughout, regardless of where the heir is based.
